SMS Terms & Conditions

These SMS Terms & Conditions (“SMS Terms”) govern your participation in the text-message program operated by Peak Outdoor Living LLC (“Peak Outdoor Living,” “we,” “our,” or “us”). By providing your mobile number to Peak Outdoor Living through any of the methods described below, you agree to these SMS Terms and to our Privacy Policy.

1. Program Name and Description

Program name: Peak Outdoor Living Customer Care SMS.

Description: Peak Outdoor Living is a licensed Arizona landscape, pool, and outdoor-living contractor (ROC #357066). We use SMS to communicate with customers and prospects about their projects. Message types include:

2. How You Opt In

You may opt in to receive SMS messages from Peak Outdoor Living in any of the following ways:

  1. Website form. You submit our quote-request or contact form at peakoutdoorsliving.com and provide your phone number, after checking a box stating: “By providing my phone number, I agree to receive text messages from Peak Outdoor Living about my project, including appointment reminders, quotes, and job updates. Message and data rates may apply. Reply STOP to opt out, HELP for help. Message frequency varies.”
  2. In person. A Peak Outdoor Living sales representative collects your phone number during an on-site or in-office consultation, after informing you that we will text you appointment confirmations, quotes, and job updates.
  3. Customer-initiated. You text our published business number, (480) 725-8228, first.

You may also text START, SUBSCRIBE, or YES to (480) 725-8228 to opt in.

3. Message Frequency

Message frequency varies based on the activity of your project. During active design and construction phases you may receive several messages per week. Between phases you may receive few or no messages.

4. Costs

Message and data rates may apply. Peak Outdoor Living does not charge for the messages themselves, but your mobile carrier may charge you for sending or receiving messages depending on your plan. Check with your carrier if you have questions about your plan.

5. How to Opt Out (STOP)

You can opt out of receiving SMS messages from Peak Outdoor Living at any time by replying STOP, UNSUBSCRIBE, CANCEL, END, or QUIT to any of our messages. After you opt out you will receive a final confirmation message, and you will not receive any further texts from us unless you opt back in. To opt back in, reply START or contact us directly.

7. Supported Carriers

Our SMS program is available on most major U.S. carriers, including AT&T, T-Mobile, Verizon Wireless, Sprint, Boost, U.S. Cellular, MetroPCS, Cricket, Virgin Mobile, and most regional and prepaid carriers. Carriers are not liable for delayed or undelivered messages.

8. Eligibility

You must be at least 18 years old and the account holder or authorized user of the mobile number you provide. By providing your number you confirm both.

9. Privacy and Data Sharing

We respect your privacy. Peak Outdoor Living will not share, sell, rent, or otherwise disclose your mobile phone number or SMS opt-in data to any third party or affiliate for marketing purposes. We share information only with the service providers, subcontractors, and crew necessary to deliver your project, as described in our Privacy Policy.

10. Changes to These Terms

We may modify or terminate the SMS program, or update these SMS Terms, at any time. We will post the updated SMS Terms on this page with a new Effective Date. Continued participation in the program after changes are posted constitutes your acceptance of the revised terms.
